("Influx," "we," "us," or "our") operates the Growthstack™ platform, including the Growthstack website at www.Growthstack.app (the "Website") and the Growthstack mobile applications for iOS and Android (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our Website, use our App, or otherwise interact with the Service. The Service is built upon technology and infrastructure provided by third-party platform providers under license to Influx. These third-party providers may process, store, or transmit data on our behalf in connection with the delivery of the Service, subject to appropriate data handling agreements.

If you are located in Canada, your personal information may be processed and stored in the United States and subject to U.S. laws. We make reasonable efforts to align with the principles of the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial legislation. The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, and processed in the United States or other countries where our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction. By using the Service, you consent to the transfer of your information to these countries.

11. HIPAA and Protected Health Information

The Service is designed for healthcare providers and professionals who may use the Service to manage, store, process, or transmit information that includes or relates to Protected Health Information ("PHI") as defined under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH Act"). This may include patient names, contact information, appointment details, treatment inquiries, communication records, billing information, and other data that could identify an individual in connection with healthcare services.

Influx acts as a Business Associate (as defined under HIPAA) with respect to PHI that clients process through the Service. The handling of PHI is governed by the Business Associate Agreement ("BAA") set forth in the Influx & Growthstack Platform Terms of Use & Services Agreement. Influx implements administrative, technical, and physical safeguards designed to protect PHI in accordance with HIPAA and HITECH requirements.

If you are a Covered Entity or Business Associate under HIPAA, you must not use the Service to process PHI unless you have an active platform subscription agreement with a signed BAA in effect. You are solely responsible for determining whether your use of the Service involves PHI, for ensuring appropriate consents and authorizations are in place, and for configuring your devices and systems with appropriate security measures.

This Privacy Policy does not modify or supersede any HIPAA obligations between the parties. If there is a conflict between this Privacy Policy and the BAA regarding the handling of PHI, the BAA controls. The third-party platform providers upon which the Service is built also operate under appropriate data processing and business associate agreements to ensure HIPAA-compliant handling of PHI throughout the technology stack.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, providing additional notice through the Service or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Privacy Policy. We encourage you to review this page periodically.
